Hi, I’m Mike Hancock with Hancock Injury Attorneys and I want to answer the question that we frequently get and that is: “What are my legal rights as a passenger in a car that’s been involved in a crash?” So, first, you are entitled to bring a claim against the driver of the car that you were a passenger in, and of course you can also bring a claim if the crash was caused by the driver of another vehicle. The only limitation that you would have as a passenger is that if the driver of the vehicle you were in is a relative of yours living in the same household. That relative’s insurance would not apply to you. So, other than that, as a passenger, we all know that you are sitting there and have no fault whatsoever in causing the crash and that you are just a victim of someone else’s negligence and there’s definitely a personal injury claim that you can make.
