The Florida Highway Patrol reported that a 45-year-old motorcyclist from Gibsonton who was critically injured in a January 3, 2015 accident has succumbed to his injuries at St. Joseph’s Hospital in Tampa.
Motorcyclists Had Green Light
The motorcycle accident in which the biker suffered injury happened in eastern Hillsborough County at State Roads 60 and 39. He and another motorcyclist were southbound on State Road 39 as they approached State Road 60. They reportedly had a steady green light at the time of the incident.
Vehicle Allegedly Turns Into Their Path
A northbound 2006 Toyota SUV operated by a 65-year-old female then allegedly turned into the path of the motorcyclists on a flashing yellow turn signal. The motorcyclists laid their bikes down in an evasive maneuver, but they still slid into the path of the Toyota.
The now-deceased 45-year-old male required airlifting to St. Joseph’s Hospital with critical injuries. His fellow rider, a 44-year-old male, required transport to Tampa General Hospital because of serious injuries. According to the FHP, neither man was wearing a helmet at the time of the accident.
No Injuries in Toyota
The Toyota’s driver and her 54-year-old female passenger were not injured. The driver has not been charged, and the investigation is ongoing. Florida state law does allow victims and survivors of motorcycle accidents to seek compensation when negligent conduct causes injury or loss of life.
Legal Action
It is possible to assert negligent conduct in civil court even if there is no criminal charge. For example, a wrongful death attorney may file suit on behalf of survivors to seek compensation for burial expenses and loss of consortium. Such a case is often settled with a motorist’s insurer without a trial.
