The following is one of many car accident questions asked on avvo.com which attorney Mike Hancock answered in October, 2013.
Car Accident Question: I got in a small accident and the person who I hit went to the hospital 12 days later. He is now claiming that he is injured. I am certain that he is making this up as the accident was very minor. What should I do?
Mike Hancock’s Answer: I receive car accident questions like yours everyday. Call your auto insurance company and report this incident as a new claim. Your insurance adjuster will handle it from there. You have a duty in Florida to cooperate with your own insurance company. Take photos and/or video of the damage or lack of damage to your vehicle, even if you don’t think it will show up in the photos. Use a coin or some other object next to the damage to give a size reference of the damage. Take photos or video of the scene of the accident.
