Who to Sue in a Wrongful Death Accident?
Dealing with the aftermath of a wrongful death is overwhelming, emotional and confusing. When you lose a loved one, your first priority is laying them to rest and honoring their life. Unfortunately it is crucial to think about the legal aspects of the wrongful death. In some wrongful death cases it is just gross negligence, sometimes their is criminal acts, such as assault involved and sometimes medical professionals might have caused the death.
While we don’t handle medical malpractice cases, we wanted to at least answer the question on if you are even able to sue a doctor, nurse or hospital:
Parents, spouses and children can file suit. Some states allow the extended family to file suit as well. When suing a hospital or doctor related to wrongful death, you have to give the medical professional a notice letter before the lawsuit can be filed.
If a doctor or nurse, etc. is found negligent and causes a wrongful death, the medical group, hospital and professional can all b held liable.
Damages to recover in a wrongful death case include funeral expense, pain and suffering, medical bills and a loss of income. We know this is a hard time for your family, but hopefully we can make it a little less stressful.
